LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 14, 2009

TO:
Honorable Todd Hunter, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2702 by Dunnam (Relating to the adoption of rules of civil procedure by the supreme court.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to the adoption of rules of civil procedure by the supreme court. The bill would restrict the Supreme Court to promulgate rules of civil procedure only during the first 95 days of a regular legislative session. To the extent the rules change would change court procedure for the Supreme Court, the LBB's analysis of the bill anticipates any additional work for the Supreme Court resulting from passage of the bill could be reasonably absorbed within current resources. The bill would take effect immediately if it receives two-thirds votes in both houses, otherwise the bill would take effect September 1, 2009.

Local Government Impact

No fiscal implication to units of local government is anticipated.
