FROM: | John S. O'Brien, Director, Legislative Budget Board |
IN RE: | HB2707 by Hochberg (Relating to the jurisdiction of certain courts in suits affecting the parent-child relationship.), Committee Report 1st House, Substituted |
The bill would amend the Family Code relating to the jurisdiction of certain courts in suits affecting the parent-child relationship. The bill would provide that, not withstanding any other provision, a state court may exercise jurisdiction in child custody cases if a court in a foreign country has not provided notice and an opportunity to be heard in accordance with state law. To the extent the bill would amend court procedures, no significant increase in judicial workloads or fiscal implication to the State is anticipated. The bill would take effect September 1, 2009.
