No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code, Section 2.02 and 2.03 to indicate the basis for statutory cause of action under the Alcoholic Beverage Code for providing, selling, or serving alcoholic beverages to an individual, is present regardless of the person’s age.  The bill would also expand the liability for certain damages caused by the intoxication of a minor under 21 years of age.   The bill would take effect immediately if it receives a two-thirds vote of all the members in each house, otherwise it would take effect on September 1, 2009, but the provisions of the bill would only apply to causes of action that accrue on or after the effective date of the bill.

 

The Texas Alcoholic Beverage Commission (TABC) anticipates no significant fiscal impact to their agency.
