No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code, Section 1.08 by repealing Section 1.08, added by Acts 1993, 73rd Legislature, Chapter 437, §1 and Section 1.08, added by Acts 1993, 73rd Legislature, Chapter 934, §2.  The bill would also add Section 1.08 to the Alcoholic Beverage Code defining “culpable mental state” in relation to offenses or violations of the Alcoholic Beverage Code.  The bill would eliminate the duplicate numbering of the sections and allow the content to be consolidated in one new Section 1.08, Alcoholic Beverage Code, without substantive change.  The bill would take effect September 1, 2009.

 

The Texas Alcoholic Beverage Commission (TABC) anticipates no significant fiscal impact to their agency.
