FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 21, 2009

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2799 by Driver (Relating to the responsibilities of a person who qualifies for a peace officer license but has not yet been appointed as a peace officer.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Occupations Code by adding Section 1701.3075 to require persons who qualify for peace officer licenses but have not yet been appointed as peace officers to abide by the same reporting rules to the Texas Commission on Law Enforcement Officer Standards and Education (TCLEOSE).  The bill would also allow TCLEOSE to determine persons who qualify for a peace officer license but have not yet been appointed as peace officers ineligible for appointment based on events that occur after qualification has been met, but before appointment occurs.  The bill would take effect September 1, 2009.  TCLEOSE anticipates no significant fiscal impact to their agency.

Local Government Impact

No fiscal implication to units of local government is anticipated.
