LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 3, 2009

TO:
Honorable Burt R. Solomons, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2851 by Farabee (Relating to the right of certain entities to intervene in enforcement actions regarding market power abuse.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require the Public Utility Commission (PUC), upon finding that market power abuses or other violations are or may be occurring, to commence an appropriate enforcement proceeding with the goal of ending the market power abuse. The bill also would authorize certain interested parties in the enforcement proceedings to intervene. The bill would require the PUC to adopt rules to align existing rules with the bill's provisions.

Based on the analysis of the PUC, the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
