LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 3, 2009

TO:
Honorable Burt R. Solomons, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2852 by Farabee (Relating to a prohibition on retail electric providers including a change of law provision in a contract for retail electric service.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would prohibit a retail electric provider from including in a contract for retail electric service a provisions that would allow the provider to increase the price charged under the contract to recover costs to the provider that result from a change in the law. The bill would require the Public Utility Commission (PUC) to conform existing rules to the bill's provisions.

The PUC anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
