HB2985 by Phillips (Relating to the operation of certain commercial vehicles in this state.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require an application for a certificate of title filed by the owner or lessee of a foreign commercial motor vehicle to be accompanied by a copy of the applicable federal declaration form required by the Federal Motor Carrier Safety Administration (FMCSA) or its successor. The bill would require an application for a motor carrier registration to include a valid identification number issued to the motor carrier by or under the authority of the FMCSA or its successor. The bill would require the Texas Department of Transportation (TxDOT) to provide for the issuance to a motor carrier of an identification number authorized by the FMSCA. The bill would require the TxDOT to revoke or deny the registration of a for-hire motor carrier of passengers if the motor carrier is required to register with the FMCSA and the federal registration is denied, revoked, suspended or otherwise terminated.

Based on the analysis of TxDOT, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.
