FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 26, 2009

TO:
Honorable Todd Hunter, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB2992 by Gallego (Relating to authorizing a fee in bail bond forfeiture proceedings.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to allow a clerk of a district court, statutory county court, or county court to collect a fee of $42 on the entry of a judment nisi for the forfeiture of a bail bond. The fee is to be used for court-related purposes for the support of the judiciary.

Local Government Impact

Counties reported that there are not many of these types of cases filed each year and, therefore, the revenue gain would not be significant.
