Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 7, 2009

TO:
Honorable Jim McReynolds, Chair, House Committee on Corrections

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3005 by Coleman (Relating to the mandatory testing of persons suspected of exposing employees of a juvenile probation department to certain diseases.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Section 81.050(b) of the Health and Safety Code adding an employee of the juvenile probation department to the list of individuals who can request the Department of State Health Services (DSHS) or a health authority to order testing of another person who may have exposed the person to a reportable disease, including HIV infection.

The bill would take effect immediately if it receives two-thirds vote in both houses; otherwise it would take effect September 1, 2009.

DSHS estimates that any cost can be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
