No fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure relating to the authority of certain justices of the peace to issue a search warrant for a blood specimen from a person arrested for certain intoxication offenses. The bill would authorize a justice of the peace in counties with populations of 80,000 or less to issue a search warrant for blood specimens from persons arrested for certain intoxication offenses. To the extent the bill would modify court procedures, no significant effect on judicial workloads or fiscal implication to the State is anticipated. The bill would take immediate effect if the bill receives two-thirds the vote of all members. Otherwise, the bill would take effect September 1, 2009.
