No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure and the Human Resources Code relating to venue for certain offenses committed at Texas Youth Commission facilities.  The bill provides that the venue for prosecution of offenses committed by a Commission employee, officer or contractor is either in a county in which an element of the offense occurred or in Travis County. The bill also amends the Human Resources Code to provide that a prosecutor who would otherwise be prosecuting such cases may ask the Special Prosecution Unit established under Chapter E of the Government Code to prosecute or assist in the prosecution of such cases.  To the extent that the bill affects venue for prosecution of offenses committed at Texas Youth Commission facilities, no significant fiscal implication to the State is anticipated.  The bill would take effect September 1, 2009.
