No significant fiscal implication to the State is anticipated.
The bill would require the exchange of information concerning at-risk youth among the Youth Commission (TYC); the Juvenile Probation Commission (JPC); the Department of Family and Protective Services (DFPS); the Texas Education Agency; juvenile probation departments; school districts or open-enrollment charter schools; local mental health or mental retardation (MHMR) agencies; county health departments; hospital districts; county departments that provide services to at-risk youth or their families; and child advocacy centers for victims of child abuse established through a memorandum of understanding (MOU) between community entities. An agency named in this bill would be required, at the request for specific information by another agency, to disclose personally identifiable information that is otherwise confidential, including information contained in educational records. The requesting agency would be required to certify in writing that the agency will not disclose confidential information received with this authority to a third party other than another agency. The bill would take effect September 1, 2009, unless it receives the necessary vote to become effective immediately.
Local Government Impact
According to the Texas Association of Counties, the provisions of the bill are not anticipated to have a significant fiscal impact to local government entities.
