No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code, Subchapter C, Chapter 11 and Subchapter C, Chapter 61 to add provisions outlining the requirements necessary for the Texas Alcoholic Beverage Commission (TABC) to temporarily suspend the permit or license of a person permitted to sell alcoholic beverages for on-premises consumption if TABC receives a petition that meets the requirements outlined in the bill.  The bill would also provide guidelines for hearings and require the TABC to attempt mediation between residents who provided the petition and the permit or license holder.  The bill would also stipulate a permit or license could not be suspended if the permit or license holder employs a licensed security guard or off-duty peace officer to provide security for the permitted premises.  The bill would take effect September 1, 2009.  This analysis assumes the costs associated with the bill’s provisions could be absorbed with TABC’s current appropriations.
