No significant fiscal implication to the State is anticipated.

The bill would amend the Agriculture Code to create the Texas Nursery and Floral Account, which would be funded from an optional fee from nursery and floral owners and would allow the Department of Agriculture (TDA) to make grants to promote and market the Texas nursery and floral industries.

The bill would create the Texas Nursery and Floral Advisory Council to be coordinated by TDA to advise the department on the most effective methods for promoting and marketing the Texas nursery and floral industries.

Based on LBB's analysis of TDA, the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

There would be additional revenue generated as a result of this bill, but it is not anticipated to be significant.

This legislation would do one or more of the following: create or recreate a dedicated account in the General Revenue Fund, create or recreate a special or trust fund either with or outside of the Treasury, or create a dedicated revenue source. The fund, account, or revenue dedication included in this bill would be subject to funds consolidation review by the current Legislature.

The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house; otherwise it would take effect September 1, 2009.
