LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 28, 2009

TO:
Honorable Garnet Coleman, Chair, House Committee on County Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3601 by Paxton (Relating to the authority of a county clerk to post official and legal notices by electronic display.), Committee Report 1st House, Substituted

No fiscal implication to the State is anticipated.

The bill would designate Sections 82.001 through 82.005 of the Local Government Code as Subchapter A, Chapter 82 and add Subchapter B Section 82.051, which would allow a county clerk the option to post an official and legal notice on an electronic display or the county's website instead of posting a physical document. The electronic display must meet the time requirements provided by law for the posting of the notice.

Local Government Impact

If the county clerk's office already has the equipment that would allow electronic display of notices, then no significant fiscal implication to units of local government is anticipated.
