FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 28, 2009

TO:
Honorable Joe Straus, Speaker of the House, House of Representatives

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3628 by Jones (Relating to the date by which the executive director of the Texas Department of Licensing and Regulation must require compliance with certain elevator safety standards. ), As Passed 2nd House

No significant fiscal implication to the State is anticipated.

The bill would extend the delay to September 1, 2012 that the executive director of the Texas Department of Licensing and Regulation (TDLR) can grant for compliance with the requirements for  firefighter's service in the ASME Code for elevator safety standards. TDLR would be required to adopt rules to implement the provisions of the bill. The bill would authorize the executive director of TDLR to grant a delay until September 1, 2010 for complaince with the requirements for door restrictors in the ASME Code.

TDLR anticipates any additional work resulting from the passage of the bill could be reasonably absorbed within current resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
