No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to require that each law enforcement agency adopt physical readiness standards that a law enforcement officer appointed or employed by the agency must meet.  The bill would allow a law enforcement agency to transfer an officer who fails to meet a physical readiness standard to a position classified at the same or higher salary level.  The bill would take effect September 1, 2009. 

This analysis assumes that implementing the provisions of the bill would not pose a significant fiscal or operational impact to law enforcement agencies in the State.


Local Government Impact

Local law enforcement agencies would be required to adopt physical readiness standards in consultation with physical readiness experts that must be directly related to an officer’s functional job description and performance standards. The fiscal impact to local governmental entities could be significant, but would vary depending on the standards currently in place, the number of law enforcement persons employed by an entity, and the costs for consulting physical readiness experts.
