The bill would add Subchapter I to Chapter 775, Health and Safety Code, to authorize an emergency services district to impose and collect an impact fee against a new development of property in the district on the terms and in the manner provided for imposition and collection of an impact fee by a political subdivision under Chapter 395, Local Government Code.
The bill would take effect immediately if it were to receive the required two-thirds vote in each house; otherwise, it would take effect September 1, 2009.
Chapter 395, Local Government Code, establishes provisions, requirements, and procedures for imposing an impact fee to finance capital improvements required by new development.
Emergency service districts would experience a revenue gain if they choose to impose and collect an impact fee. The revenue gain would depend on the amount of fee set (based on the formula provided in Chapter 395, Local Government Code) and the number of new developments.| Source Agencies: |
