The bill would provide an expedited process for the review of air permit applications to the Texas Commission on Environmental Quality (TCEQ) for rock crushers meeting certain requirement as prescribed by the bill. To qualify for the streamlined process created by the bill, an applicant would need to meet the following: have a high compliance history rating; create a buffer zone around the crusher and quarry; operate the crusher and quarry in accordance with the best management practices; and reclaim the quarry after closure. The bill would require the TCEQ to: take final action on applications within 60 days after receiving an administratively complete application; use public meetings, informal conferences, or advisory committees to gather public comment; and adopt rules to implement the bill no later than January 1, 2010. Permits authorized under this section would not be subject to contested case hearings.
Any additional costs to the TCEQ resulting from the bill's passage are not expected to be significant.
