LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 26, 2009

TO:
Honorable Tommy Merritt, Chair, House Committee on Public Safety

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3883 by Alonzo (Relating to certain warning signs required on certain premises.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Alcoholic Beverage Code and the Government Code to require signs displayed at certain establishments owned by permit or license holders under the Alcoholic Beverage Code and certain hospitals and nursing homes to indicate the prohibition against the carrying of handguns by persons licensed to carry concealed handguns does not apply to peace officers or honorably retired peace officers.   The bill would also amend the Penal Code, Section 30.06 to exempt peace officers and honorably retired peace officers from prohibitions against the carrying of concealed handguns at certain establishments.  The bill would take effect September 1, 2009.  This analysis assumes the implementation of the bill’s provisions could be absorbed within the Texas Alcoholic Beverage Commission’s (TABC) current appropriations.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
