LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 27, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB3932 by Harper-Brown (Relating to the establishment of a road user fee pilot program by the Texas Department of Transportation.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would make no appropriation but could provide the legal basis for an appropriation of funds.

This bill would amend the Texas Transportation Code to require the Texas Department of Transportation (TxDOT) to establish a pilot program in at least one county that is part of a regional mobility authority to study the feasibility of assessing a road user fee based on the number of miles traveled in Texas by a motor vehicle. TxDOT would be required to have the approval of the commissioners court of the county to operate the pilot. The bill sets forth certain required criteria to be included in the program and would authorize TxDOT to contract with an RMA or the Texas A&M University System or both to implement or administer the program. The bill would require TxDOT to submit a report to the legislature regarding the feasibility of implementing a road user fee based on the number of miles traveled and legislation to implement this fee.

The bill would require TxDOT to set the amount of the road user fee on a per mile basis and sets forth requirements for consideration in determinig the amount of the fee.

The bill would take effect on September 1, 2009. TxDOT would be required to establish the required pilot program not later than December 31, 2010. The statutory requirements resulting from this bill would expire September 1, 2013.

TxDOT reports federal funds could be used for the study, which would require a state match. It is expected that this could be provided within the agency's existing resources. No other significant fiscal impact is expected to the state.

Local Government Impact

No fiscal implication to units of local government is anticipated.
