Fiscal Analysis

The bill would amend the Parks and Wildlife Code relating to fees for certain licenses issued by the Texas Parks and Wildlife Department (TPWD).  The bill would allow the Texas Parks and Wildlife (TPW) Commission to increase specific licenses by no more than 20 percent of the amount set and effective on September 1, 2002 (fiscal year 2003).  The expiration date to allow this increase is September 1, 2013.  TPWD indicates the five licenses that would be affected are as follows:  the Wholesale Fish Dealer License (Section 47.009), the Retail Fish Dealer License (Section 47.011), the Retail Dealer Truck License (Section 47.013), the Commercial Bay Shrimp Boat License (Section 77.031) and the Commercial Gulf Shrimp Boat License (Section 77.035). 

This analysis assumes the TPW Commission would approve fee increases for these particular licenses and the estimated revenue gain to the General Revenue-Dedicated Game, Fish and Water Safety Account No. 9 would be approximately $150,884 per fiscal year.  TPWD indicates any TPW Commission action would not be likely to take effect until fiscal year 2011.  Also, TPWD reports the TPW Commission increased the fees for the previously noted licenses in fiscal year 2004 by 10 percent, and the bill would allow a fee increase of an additional 10 percent up to the cap of 20 percent, and the $150,884 in additional revenue would reflect the 10 percent increase.  The bill would take immediate effect if the bill receives two-thirds the vote of all members.  Otherwise, the bill would take effect September 1, 2009.


Methodology

Using fiscal year 2008 data, the 10 percent increase multiplied by the total number of each license sums to $150,884.40 and is as follows:

Wholesale Fish Dealer License, 547 licenses x $75 = $41,025
Retail Fish Dealer License, 2,652 licenses x $8.40 = $22,276
Retail Dealer Truck License, 745 licenses x $15.60 = $11,622
Resident Commercial Bay Shrimp Boat License, 572 licenses x $34.80 = $19,905
Non-Resident Commercial Bay Shrimp Boat License, 1 licenses x $75 = $75
Resident Commercial Gulf Shrimp Boat License, 818 licenses x $45 = $36,810
Non-Resident Commercial Gulf Shrimp Boat License, 142 licenses x $135 = $19,170
