LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 4, 2009

TO:
Honorable Joe Deshotel, Chair, House Committee on Business & Industry

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB4372 by Elkins (Relating to the resolution of overpayment or underpayment of income benefits under the workers' compensation program.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Labor Code regarding over and under payments of income benefits in the workers' compensation system.  The bill would require the Texas Department of Insurance (TDI) to adopt rules relating to the resolution requirements for over and under payments.  Based on the analysis by TDI,  it is assumed that any costs associated with the implementation of this bill could be absorbed within existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
