LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 24, 2009

TO:
Honorable John T. Smithee, Chair, House Committee on Insurance

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB4402 by Martinez Fischer (Relating to a study regarding insurance coverage of prescription drugs provided under a health benefit plan.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Insurance Code to require the Texas Department of Insurance (TDI) to conduct a study to evaluate the ways in which pharmacy benefit managers use prescription drug information. The bill would require TDI to create a report with the findings of the study to be submitted no later than August 1, 2010. The agency indicates there would be some cost to implement the provisions of the bill, but these costs are expected to be absorbed within the agency's existing budget.

Local Government Impact

No fiscal implication to units of local government is anticipated.
