LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 1, 2009

TO:
Honorable Burt R. Solomons, Chair, House Committee on State Affairs

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HB4610 by Oliveira (Relating to cost recovery by a transmission and distribution utility of distribution system costs.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would establish that the legislature finds it is in the public interest to promote investment in electricity distribution systems. The bill would amend Section 36.204 of the Utilities Code to require the Public Utility Commission (PUC) to adopt rules to provide a more expeditious regulatory process for the recovery of costs for investment in and maintenance ofdistribution systems.

The PUC indicates it could absorb the costs associated with the bill within its current resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
