The resolution would propose a constitutional amendment to Article VIII of the Texas Constitution to authorize the Legislature to exempt from ad valorem taxation a percentage of the market value of the residence homestead of a partially disabled veteran that is equal to the percentage of disability of the disabled veteran.
The proposed amendment would not affect the exemption of any limitations under existing Article VIII, Section 2(b) of the Texas Constitution, which provides fixed amount exemptions based on the percentage of a veterans disability and includes property other than the veteran's residence homestead.
The proposed amendment would be submitted to voters at an election to be held November 3, 2009. If adopted, the provisions would be effective January 1, 2010, and would apply only to a tax year beginning on or after that date.
