FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 21, 2009

TO:
Honorable Rene Oliveira, Chair, House Committee on Ways & Means

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
HJR75 by Villarreal (Proposing a constitutional amendment authorizing the governing body of a municipality to exempt a portion of the value of a residence homestead from ad valorem taxation if the homestead meets certain energy efficiency standards.), As Introduced

No fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $90,882.

The resolution would require a proposed amendment to the Texas constitution be placed on the ballot at an election to be held November 3, 2009. The proposed amendment would authorize a municipality to exempt a portion of the value of a residence homestead from ad valorem taxation if the homestead meets certain energy efficiency standards.

Local Government Impact

No fiscal implication to units of local government is anticipated regarding adding the proposed amendment to an election. If the proposed amendment is placed on the ballot and approved by the voters, the fiscal impact to a municipality would depend on decisions made by the governing body and on the participation of residents.
