FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 10, 2009

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB35 by Zaffirini (Relating to mortality review for certain individuals who are developmentally disabled.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend Chapter 161, Human Resources Code, by adding Subchapter F, Mortality Review for Certain Individuals who are Developmentally Disabled. A mortality review team would be established for each mental retardation authority's catchment area to review the deaths of individuals with developmental disabilities who resided in or received services from a facility licensed, or agency operated by DADS, at the time of the individual's death. Members of review teams would not be entitled to compensation for serving on the team but would be entitled to reimbursement for travel.

It is assumed any cost to implement provisions of the bill would be minimal and can be absorbed within available resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
