No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practices and Remedies Code relating to limitation of a liability for certain emergency care provided during a declared disaster. The bill would exempt physicians or health care providers from liability for providing emergency care during the scope of their employment at the scene of a disaster. To the extent the bill amends limitations of liability, the rules change is not anticipated to increase the workload of the courts. The bill would take effect immediately if it receives a two-thirds vote of each house. If the bill does not receive the necessary votes the bill would take effect September 1, 2009.
