No significant fiscal implication to the State is anticipated.

SECTION 2 of the bill would amend Section 42, Human Resources Code, to require that the Department of Family and Protective Services (DFPS) include a link on its website to the United States Consumer Product Safety Commission website. The bill would prohibit the use of an unsafe children’s product at day-care centers, group day-care homes, or registered family homes. DFPS would be required to notify a facility of the provisions of the bill at the pre-application interview for a license, registration, or certification and during an inspection of the facility. The bill would require the executive commissioner of the Health and Human Services Commission to adopt rules to implement the section. The bill would take effect September 1, 2009. Both agencies indicate that any costs associated with implementation of the bill could be absorbed within existing resources.
