No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code relating to certain procedures, powers, and operations of property owners' associations. Property owners' associations are not units of local government; however, certain procedures would require certain filings by associations with county clerks. In addition, the bill would require the Supreme Court of Texas to adopt rules establishing expedited foreclosure proceedings for use by a property owners' association in foreclosing an assessment lien of the association. The court would be required to adopt rules by not later than January 1, 2010.
