No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code relating to procedures required to foreclose a property owners' association's assessment lien.

The bill would require the Supreme Court to adopt rules of civil procedure establishing expedited proceedings for foreclosure of a property owners' assessment lien not later than January 1, 2010. The rules adopted would be required to be substantially similar to the rules adopted by the Supreme Court under Section 50(r), Article XVI, Texas Constitution. The Supreme Court anticipates no significant fiscal implication as a result of the rulemaking requirements in the bill.

No significant fiscal implication to units of local government is anticipated.
