LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 11, 2009

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB345 by Nelson (Relating to screening health care personnel of home and community support services agencies for tuberculosis.), As Introduced

No significant fiscal implication to the State is anticipated.

Section 1 of the bill would add language to Section 142.012(b) of the Health and Safety Code to require the setting of minimum standards relating to tuberculosis screening of home and community support service agency personnel for those agencies licensed under Chapter 142 of the Health and Safety Code. Section 2 of the bill would require the Texas Board of Nursing to adopt rules required by the section that would be amended.

It is assumed any direct cost to implement provisions of the bill would be minimal and could be absorbed within available resources.

It is possible that to the extent that home and community support service agencies are Medicaid providers, the state could incur costs related to the screening of personnel.  However, this would be an indirect cost of the bill.

Local Government Impact

No fiscal implication to units of local government is anticipated.
