No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code, to specify the authority of the Texas Department of Transportation (TxDOT) to mitigate an adverse environmental impact that is a direct result of the construction, improvement, or maintenance of a state highway or the construction, improvement, or maintenance of a facility used in connection with the construction, maintenance, or operation of a state highway.

Based on the analysis of TxDOT, it is assumed the provisions of the bill would not result in a significant fiscal impact to the state.

The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2009.
