No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require the Texas Transportation Commission (TTC) to allow subsurface access to a controlled access highway right-of-way for the installation of a natural gas pipeline that does not interfere with existing utilities located in the right-of-way. The bill would authorize TTC to regulate the horizontal or vertical location of the pipeline within the right-of-way. The bill would authorize TTC to require a natural gas pipeline operator pay for the relocation of facilities to accommodate construction or expansion of the highway or for any other public work.

Based on the analysis of the Texas Department of Transportation, it is assumed any additional costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.
