LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 19, 2009

TO:
Honorable John Carona, Chair, Senate Committee on Transportation & Homeland Security

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB713 by Carona (Relating to a prohibition on the disclosure and use of certain information recorded or collected by a transponder used to electronically assess or collect a toll.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to prohibit the disclosure or use of vehicle speed information collected by a transponder (toll tag) for the purpose of enforcing or prosecuting an offense under the Transportation Code where vehicle speed was a factor.

The Texas Department of Transportation (TxDOT) has indicated that its toll tags and tag readers currently do not collect vehicle speed information. Based on the analysis of TxDOT and the Department of Public Safety, it is assumed the provisions of the bill would not result in a significant fiscal impact to the state.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
