No fiscal implication to the State is anticipated.

The bill would amend the Property Code to require a hospital or emergency medical services provider seeking to secure a lien on a cause of action or claim of an individual who receives hospital services for injuries caused by an accident that is attributed to the negligence of another person, to send a written notice of the lien, certified and return receipt requested, to the injured individual at the person's last known address. The notice must be sent not later than the 10th day before the date a hospital or emergency services provider files a notice with the county clerk. The bill specifies what information is required to be included in the written notice. No notice would have to be mailed if the notice is provided in a written document separate from any other documents signed by or provided to the individual or their representative at the time of admission to the hospital or at the time the emergency medical services are provided.
