TO:
Honorable Florence Shapiro, Chair, Senate Committee on Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB867 by Lucio (Relating to summer nutrition programs provided for by school districts.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would require school districts in which 50 percent or more of the students are eligible to participate in the federal free or reduced-priced lunch program to provide a summer nutrition program unless the Texas Department of Agriculture (TDA) granted a waiver.

The bill would require the Texas Education Agency to provide a list of school districts with 50 percent or more students qualifying for the national free or reduced-priced lunch program to TDA annually.

The bill would require TDA to notify each field office and qualifying school district of its requirement to provide a summer nutrition program during the next summer recess.

The bill would require TDA and TEA to joint develop a plan for increasing access to summer nutrition programs.

No significant impact to the state is anticipated.

Local Government Impact

School districts that had not previously provided summer nutrition programs in the past might incur administrative and start-up costs to implement the provisions of the bill.
