LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 20, 2009

TO:
Honorable Joseph Pickett, Chair, House Committee on Transportation

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB882 by Carona (Relating to the powers and duties of a regional tollway authority.), Committee Report 2nd House, Substituted

No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to provide that a regional tollway authority would have the same powers and duties as the Texas Department of Transportation under Chapter 228, a county under Chapter 284, and a regional mobility authority under Chapter 370, regarding the authority's toll collection and enforcement powers for the authority's turnpike projects and other toll projects developed, financed, constructed, or operated under an agreement, including a comprehensive development agreement, with the authority. The bill also includes additional procedures related to contracts entered into by the authority.

According to the Texas Department of Transportation, there is only one regional tollway authority established, which is the North Texas Tollway Authority.

Local Government Impact

Because the bill would not have statewide impact on units of local government of the same type or class, no comment from this office is required by the rules of the House/Senate as to its probable fiscal implication on units of local government.
