No fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to specify that the Texas Department of Transportation (TxDOT) may not pledge or encumber money in the State Highway Fund to guarantee a loan obtained by a public or private entity for costs associated with a toll facility of the public or private entity; or insure bonds issued by a public or private entity for costs associated with a toll facility of the public or private entity. The provisions of the bill would only apply to an agreement entered into on or after the effective date of the bill. The bill would also exempt certain transportation projects from the provisions of the bill. The bill would take effect immediately upon receiving a vote of two-thirds of all members elected to each house or otherwise on September 1, 2009.

Based on the analysis of TxDOT, it is assumed the provisions of the bill would not result in fiscal implications to the state.


Local Government Impact

No significant fiscal implication to units of local government is anticipated.
