No significant fiscal implication to the State is anticipated.

The bill would amend Section 411.081(i), Government Code, by adding to the list of entities to which a criminal justice agency may disclose criminal history record information. The bill would allow the disclosure of criminal history record information to the Guardianship Certification Board and Offices of the County Clerk in instances related to a proceeding for the appointment of a guardian under Chapter XIII, Texas Probate Code. The Department of Public Safety indicates that implementing the provisions of the bill would not pose a significant fiscal impact on its resources or operations.

The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house. If it does not receive the vote necessary for immediate effect, the bill would take effect September 1, 2009.
