LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

March 24, 2009

TO:
Honorable Rodney Ellis, Chair, Senate Committee on Government Organization

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1149 by Hegar (relating to authorizing the Texas Board of Criminal Justice to sell certain real property for municipal airport expansion.), Committee Report 1st House, Substituted

The amount of gain to the Texas Capital Trust Fund is unknown and would depend upon the amount of proceeds received from the sale of approximately 85 acres of land adjacent and east of the Sugarland Regional Airport.

The bill would require the Texas Board of Criminal Justice to authorize the sale of approximately 85 acres of land adjacent and east of the Sugarland Regional Airport to the city of Sugarland. The land is primarily utilized as employee housing for the Department of Criminal Justice (TDCJ). Proceeds of the sale and the net of any remediation costs would be deposited in the Texas Capital Trust Fund and not specifically appropriated to the Department of Criminal Justice. TDCJ would have costs associated with the loss of employee housing (five single family homes and 36 duplex housing units).

Local Government Impact

The cost to a municipality would depend on the fair market value of the land the municipality would seek to purchase. It is assumed that the municipality would seek to make the purchase only if sufficient resources would be available and the purchase would benefit the municipality.
