LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 23, 2009

TO:
Honorable Jane Nelson, Chair, Senate Committee on Health & Human Services

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1415 by Hegar (Relating to certain corrective actions by the Texas Board of Nursing, including a pilot program on deferred disciplinary action; providing corrective actions.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require the Texas Board of Nursing to determine the feasibility of conducting a pilot program designed to evaluate the efficacy of board deferral of disciplinary action against a licensee. If the board determines the pilot program is feasible, the board shall develop and implement the pilot program no later than February 1, 2011 and conclude the program by January 1, 2014. The bill would require the Board of Nursing to appoint an advisory committee to assist the board in overseeing the pilot program. The bill would also authorize the Board of Nursing to impose a corrective action on a person licensed or regulated by the board who commits a violation. The bill would establish the terms of the corrective action and reporting requirements regarding the corrective action.

The Texas Board of Nursing indicates that any costs associated with the bill could be absorbed within the agency's existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
