The bill would amend the Transportation Code to authorize the Texas Department of Transportation (TxDOT) to enter into an agreement with the Department of Public Safety (DPS), a federal law enforcement agency, or a local law enforcement agency operating an automatic license plate identification camera (camera) under the authority of a federal law enforcement agency that authorizes a program to install, maintain, and operate a camera on state highway rights-of-way. The bill would prescribe general terms for such an agreement and purposes for which images produced by the camera may be used.
The bill would create as a Class C misdemeanor offense the act of using an automatic license plate identification camera other than in the manner and for the purpose specified by the provisions of the bill. A Class C misdemeanor is punishable by a fine not to exceed $500.
Based on the analysis of TxDOT and DPS, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within existing resources.
