LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 9, 2009

TO:
Honorable Troy Fraser, Chair, Senate Committee on Business & Commerce

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1428 by Williams (Relating to the power of the Texas Department of Licensing and Regulation to issue emergency orders and temporary and emergency licenses.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would authorize the executive director of the Texas Department of Licensing and Regulation (TDLR) to issue an emergency order. If an emergency order is issued without a hearing, the bill would require the executive director to set the time and place for a hearing conducted by the State Office of Administrative Hearings (SOAH) within 10 days. The bill would also authorize TDLR to provide by rule for the issuance of a temporary license.

Based on the analysis of TDLR and SOAH, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
