LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 16, 2009

TO:
Honorable Royce West, Chair, Senate Committee on Intergovernmental Relations

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1448 by West (Relating to actions in a justice court regarding the repair of residential rental property.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code to create specific court procedures for justice court actions regarding the repair of residential rental property. Additionally, the bill would require the Supreme Court, by not later than January 1, 2010, to adopt rules of civil procedure applicable to the orders of repair issued by a justice court.

Based on analysis by the Office of Court Administration, it is assumed that any costs associated with implementation could be absorbed within existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
