FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

May 4, 2009

TO:
Honorable Rob Eissler, Chair, House Committee on Public Education

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1490 by Watson (Relating to requirements for the conduct of Texas Education Agency special education due process hearings.), As Engrossed

No significant fiscal implication to the State is anticipated.

This bill would require the Texas Education Agency (TEA) to enter into a contract with the State Office of Administrative Hearings (SOAH) that would provide for the SOAH to conduct the special education due process hearings.

TEA would still retain responsibility under the federal Individual with Disabilities Education Act (IDEA) for ensuring that the hearing process meets all federal regulatory requirements and timelines.

No significant fiscal impact to the state is anticipated.

Local Government Impact

No fiscal implication to units of local government is anticipated.
