LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 81ST LEGISLATIVE REGULAR SESSION

April 8, 2009

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John S. O'Brien, Director, Legislative Budget Board

IN RE:
SB1506 by Whitmire (Relating to the payment of the costs associated with certain conditions of bond.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to authorize requiring a defendant who is placed on electronic monitoring or required to be tested for use of controlled substances as a condition of bond to pay for those services as a condition of bond.  If those costs are imposed, the bill would authorize a magistrate to revoke a defendant's bond and order the defendant arrested if they fail to pay those costs.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
