No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure and the Penal Code relating to the prosecution of sexual offenses and to the exemption from the duty to register as a sex offender by certain persons. The bill would establish an affirmative defense to prosecution of certain sexual offenses; allow a person to petition the court for an exemption from the duty to register as a sex offender under certain circumstances; and makes changes to the criteria for findings of fact related to the age of the defendant in sexual offense cases. The Office of Court Administration and the Department of Public Safety anticipate no significant fiscal implication to the State from the provisions of the bill.
